EVESHAM TOWNSHIP OVERPASS RESOLUTIONS (SUMMARY)


December 16, 1997:  Town Council adopts Resolution 317-97 in support of “Improvement Plan Alternate A” dated November 1994 (an at-grade intersection) and requests that NJDOT "proceed further with the design and construction of the project".

December 21, 1999:  Town Council adopts Resolution 340-99 in support of “Revised Improvement Plan Alternate A” dated December 1999 (an at-grade intersection) and requests that NJDOT proceed further with the design and construction of the project.

February 15, 2000:  Town Council adopts Resolution 23-2000 in support of “Original Improvement Plan Alternate A” dated November 1994 (an at-grade intersection) and requests that NJDOT proceed further with the design and construction of the project.

June 19, 2001:  Town Council (“aye” - D’Andrea, Macready, O’Rourke and Mayor Tamburro) adopts Resolution 124-2001 in support of “Revised Improvement Plan Alternate 3B” dated March 27, 2001 (an Overpass) subject to the following conditions:

  • Council “would like to ensure that once the entire Circle study is complete, the NJDOT will address these other areas of the Township’s concerns, including the impact on the above-referenced intersections” (Cropwell, Lincoln, Cooper, Baker, Maple, Brick, Evesham and Centre).
  • Council “requests the NJDOT to investigate the feasibility of lowering the length and height of the overpass structure and investigate and incorporate a pedestrian, bicycle and vehicular circulation plan for the area, particularly in the area of the Promenade shopping center”.
  • Council “requests the NJDOT to provide them with a model of the overpass and surrounding areas”.
  • Council “wishes to minimize any impact on the DeSimone BMW property” as indicated in their attorney’s correspondence dated May 29, 2001.
  • Council “requests the NJDOT to use its best efforts to minimize the impact on all other adjacent businesses, to the degree reasonably possible”. 

“and the Township requests that the DOT proceed further with the design of the project.” . . . “it is an express condition of this resolution of support that the above-referenced conditions be addressed by the NJDOT.” 

Note:  The Minutes (June 19, 2001) of this Council Meeting give no indication of the presence of any residents following early comments by the president of the Woodlands Homeowners Association who requested assistance from Council “regarding problems the residents were having within the Woodland’s Development”.

Note:  The Minutes (June 19, 2001) indicate that the 4 Council members’ comments jumped around concerning several resolutions that were adopted that evening as well as other issues – widening of a road, mistaken paving of a portion of school board property, delinquent taxes, a liquor license, 400+ trash containers and a resident in the Township’s right of way.

Note:  The Minutes (June 19, 2001) show that in between the comments listed above, the Council members spontaneously interjected the following overpass issues:

  • D’Andrea “preferred word ‘Design’ in title of Resolution” and was “concerned that concerns of other business owners (Olga’s, Carollo’s, Bob’s Seafood) were not incorporated into the Resolution.”.
  • O’Rourke “Requested that the following be added to Paragraph 2: ‘pedestrian, bicycle and vehicular circulation’.”.
  • Mayor Tamburro “Requested that ‘Cooper Avenue’ be inserted in the 4th ‘Whereas’.”.

Note: Unlike the earlier resolutions related to an intersection, this resolution pertaining to an overpass says nothing about proceeding further with construction - only with study and design.  How, then, was NJDOT authorized to proceed with construction?

Note:  Bottom left margin of Resolution 124-2001 states “LAW OFFICE Parker, McCay & Criscuolo, P.A.”.


February 7, 2006:  Town Council (“aye” – Cardillo, Olt, Sarcone, Schmidt and Mayor Tamburro) adopts Resolution 38-2006 amending Resolution 124-2001 “to approve Alternative 3, as currently presented, upon the condition that the main entrance to DeSimone BMW on Route 73, North of the existing Circle, is improved for entry and exit.”.   (Note:  Sarcone and Schmidt serve on the current Council, 07Q3).
